What To Do After a DUI Arrest in Florida

The first 10 days after a Florida DUI arrest decide what happens to your license. Here is the timeline that matters.

If you’ve been arrested for DUI anywhere in South Florida — Broward County, Miami-Dade, or Palm Beach — the clock starts immediately. Having defended hundreds of criminal cases, I’ve seen too many people lose their license simply because they didn’t know about the 10-day deadline.

A DUI arrest in Florida starts two separate cases at once: a criminal case and an administrative case against your driver license. Most people only worry about the first one — and lose their license by default because of the second.

You have just 10 days from the date of arrest to request a formal review hearing with the DHSMV. Miss that window and an automatic suspension takes effect. Requesting the hearing also lets your attorney see the evidence early.

Do not assume a breath test result is the end of the road. Breath machines must be properly calibrated and maintained, the stop itself must be lawful, and field sobriety tests must be administered correctly. Each is a place a defense can be built.
