A detective wants to “just talk.” A target letter arrived. You think charges are coming. The hours before an arrest are when a defense attorney can do the most — and when most people, trying to be helpful, do the most damage to their own case.
Most criminal cases don’t start with an arrest. They start with a phone call from a detective, a business card left at your door, a search warrant, a subpoena, or a letter from a prosecutor’s office saying you are the target of an investigation. At that stage nothing has been filed, and that is exactly why it matters. What you say and do in the days before a charging decision often determines whether a case is ever filed at all, and what it looks like if it is.
The most common mistake is agreeing to “clear things up” in an interview without counsel. Investigators are trained to gather statements, and you have no obligation to give one. Once I’m retained, law enforcement and the State Attorney’s Office communicate with you through me. I find out what the investigation is actually about, decide whether any statement is in your interest, and if it is, I’m in the room when it happens.
Having worked as an Assistant Public Defender in Broward and at a defense firm in Miami, I know how cases get built before they reach a courtroom. In the pre-charge window I can preserve evidence and witnesses while they’re fresh, present exculpatory information to the prosecutor before a filing decision, and, where a warrant is unavoidable, arrange a planned surrender so you’re not arrested at work or in front of your family. Whether the investigation is a Broward Sheriff’s Office detective, a Miami-Dade police department, or a federal agency, the goal is the same: control the process before it controls you.
No charge has been filed yet — which is the point. The decisions made now can determine whether one ever is, what it’s filed as, and whether you walk in on your own terms or get taken in on theirs.
